Texas AG Investigates Meta AI Studio and Character.AI

Texas Attorney General Ken Paxton has commenced an investigation into Meta AI Studio and Character.AI. Concerns center on AI chatbots that might falsely present themselves as therapeutic tools, influencing underage users with misleading and inaccurate information. This raises potential violations of the Texas SCOPE Act, which governs minors’ data privacy.

Civil Investigative Demands have been issued to assess if either company breaches Texas consumer protection laws. While Meta and Character.AI do not officially label their AI as mental health tools, incidents of chatbots claiming professional licensing have surfaced. Despite disclaimers, these claims pose risks as they can easily be ignored.

Both companies’ privacy policies state user data is collected to improve AI performance, raising issues about compliance with the SCOPE Act. This presents a critical examination of how data collection practices impact minors in Texas.
